DIGITAL TECHNOLOGY and LAW

By Steven Brian GALLAGHER

Published in 2023 by Hong Kong CPD Courses Limited trading as Curia Books

About the Book: This book introduces how technology and law interact.  It is intended for those who may be wary of technology, wary of law, or wary of both.  If you are interested in law, then you need to know a little about the technology that is used in the practice of law and how technology is affecting law.  If you are interested in technology, then you need to know at least something of the law affecting technology.  This book considers electronic digital technology including artificial intelligence, digital property, blockchains, cryptocurrencies, non-fungible tokens (NFTs), smart contracts, decentralised autonomous organisations (DAOs), and the metaverse.  It provides explanations of how they work, and sometimes how they do not work.  It also considers how this technology is used in the practice of law and how it is affected by law.  This includes consideration of LegalTech, including artificial intelligence in the practice of law, cybercrime and cybersecurity.  This book also considers how technology is affecting law.  This includes issues arising from artificial intelligence and intellectual property, disputes involving digital property including theft, fraud, loss, divorce, death, tax, securities regulation, money laundering and insider dealing.  The liability of many parties to electronic digital technologies are considered including blockchains, their nodes, platforms, exchanges, decentralised autonomous organisations, and those living, working and playing in the metaverse.

If you are a technologist, the introduction to technology may seem basic, if you are a lawyer, the explanation of the law may seem basic, but the consideration of both may be helpful in some small way.  Hopefully, there is something of use to those who know something of technology but no law, those who know something of law but no technology, and those who know little of technology or law.

About the Author: Steven Gallagher is a Professional Consultant and Professor of Practice in Law at the Faculty of Law, The Chinese University of Hong Kong.  Steven was awarded a first class LL.B. and called to the Bar of England and Wales.  Steven teaches property law related subjects and has been teaching students in Hong Kong since 2007.  Steven is interested in new ways to teach including using superhero films to teach law. In 2016, Steven was faced with the awful realisation that he might have to learn something of digital technology.  As “teaching is the highest form of learning”, he devised and delivered a number of technology and law courses for high school students, and Continuing Professional Development (CPD) courses for practicing lawyers, the latter validated by the Law Society of Hong Kong.  This book was inspired by these courses.
